Overview
On August 24, 2023, the Owners, Strata Plan NW2599 (“Hazelwood Manor”), located at 9282 Hazel Street, Chilliwack, BC, held a special general meeting to consider, among other things, resolutions (the “Wind-Up Resolutions”) to wind-up Hazelwood Manor, to sell all the strata lots and common property to Ratzlaff Development Corp. (the “Purchaser”), pursuant to the terms of a Purchase & Sale Agreement dated for reference July 4, 2023 (the “PSA”), and appoint Mr. Derek Lai of Crowe MacKay & Company (“CMCO” or the “Liquidator”) as the liquidator of the strata pursuant to section 277 of the Strata Property Act. The Wind-Up Resolutions received a unanimous vote and, being in excess of the 80% vote required under the Strata Property Act, was passed.
On September 12, 2023, Hazelwood Manor commenced a petition in the B.C. Supreme Court seeking an order confirming the wind-up resolution passed at the Special General Meeting held on August 24, 2023.
On October 23, 2022, Justice Iyer granted an Order in the wind-up petition commenced by Hazelwood Manor
whereby all of the relief sought including the confirmation of the wind-up Hazelwood Manor, approval of the PSA with the Purchaser, and confirmation of CMCO as the Liquidator of Hazelwood Manor was approved. As such, the Liquidator now has the authority over the affairs of Hazelwood Manor.
